Pre-Launch Property in India: The Rules, Risks and Rewards

What Section 3 of RERA actually forbids, why a pre-launch booking has no statutory protection behind it, and how to engage with an unregistered project without exposure.

The short answer

A project that requires registration cannot lawfully be advertised, marketed, booked or sold until MahaRERA grants it. Registering interest is free and sensible; paying money before registration is not.

  • Section 3 of RERA prohibits marketing or sale before registration
  • A promoter cannot take more than ten per cent of the cost before a registered agreement
  • Pre-launch pricing is often genuinely lower – the discount is real, the protection is not

Pre-launch is the stage before a project is registered and formally launched, when a developer is gauging demand and building a list. It is also the stage at which buyers are most often asked for money they should not be paying yet.

This guide sets out what the law permits, what it prohibits, and how to take advantage of the genuine benefit of early engagement without taking on the exposure that usually comes with it.

What Pre-Launch Actually Means

A residential project passes through several stages: land acquisition, design, statutory approvals, RERA registration, formal launch, construction, and possession. Pre-launch sits between approvals and registration – the project is real, the land is held, drawings exist, but the regulatory step that makes it saleable has not happened.

At this stage a developer typically has an indicative configuration mix, a rough plan and an internal view on pricing, none of which is final. Marketing material circulates. Channel partners build interest lists. Prices are discussed but not published.

That is a legitimate commercial activity in itself – a developer is entitled to design a project and assess demand. What is not legitimate is converting that interest into bookings or payments before registration.

The distinction matters because the language blurs it deliberately. ‘Pre-launch offer’, ‘expression of interest’, ‘priority allocation’ and ‘soft booking’ all sound like commitments. Legally, before registration, they cannot be.

What this means for you

Treat any pre-launch document that asks for a payment as a red flag, whatever it is called. Interest lists are free; bookings are not lawful yet.

What the Law Says

Section 3 of the Real Estate (Regulation and Development) Act is direct. A promoter shall not advertise, market, book, sell or offer for sale, or invite persons to purchase, any plot, apartment or building in a real estate project – or part of it – in a planning area, without registering the project with the Real Estate Regulatory Authority.

That covers advertising as well as sale. A billboard for an unregistered project is itself outside the Act, which is why serious developers keep pre-launch communication to interest-gathering rather than promotion.

A second protection sits alongside it. A promoter cannot accept more than ten per cent of the cost of the apartment as an advance or application fee without first entering into a registered agreement for sale. So even after registration, a large payment before a registered agreement exists is outside the rules.

Registration itself is public. Once granted, the project appears on maharera.maharashtra.gov.in with sanctioned plans, the committed completion date, the promoter’s other projects and any complaints filed – all searchable by anyone.

What this means for you

The ten per cent cap applies to you personally. If you are asked for more before a registered agreement exists, stop and take legal advice.

Why Pre-Launch Pricing Is Lower

The discount is not imaginary, and it is worth understanding where it comes from.

Developers price early inventory below later phases for straightforward commercial reasons: early sales fund construction more cheaply than debt, visible momentum attracts further buyers, and a partly sold project is easier to finance. Buyers who come in first are being compensated for taking uncertainty the later buyers will not have to take.

That uncertainty is the honest description of what you are being paid for. You do not know the final layout, the exact carpet areas, the specification schedule, the phasing, or the committed completion date. You are trusting the developer’s record in place of documents that do not exist yet.

So the discount is real and the risk is real, and the sensible question is whether the first is large enough to justify the second – which you can only answer once the price list is published. Until then there is nothing to evaluate.

What this means for you

The pre-launch discount compensates you for uncertainty. If the launch price is not actually below the market, you are taking the risk without the compensation.

Stage Can the developer market it? Can you safely pay?
Pre-launch, unregistered No – Section 3 prohibits it No
Registered, before agreement Yes Up to 10% of cost only
Registered agreement executed Yes Yes, per the payment plan
Under construction Yes Against certified milestones
Occupancy certificate issued Yes Yes – and GST no longer applies

The regulatory position at each stage. The ten per cent cap is statutory, not a matter of negotiation.

The Risks, Specifically

Four risks, in rough order of how often they bite.

The project changes. Layouts, configuration mixes and amenity lists shift between pre-launch marketing and the registered brochure. Items get merged, deferred to later phases, or moved behind a separate membership. What you were shown is not what you are contractually promised.

Registration is delayed or refused. Approvals can take longer than expected or run into objections. A project can sit in pre-launch far longer than anyone intended, with your money committed and no completion date to hold anyone to.

Money paid before registration has weak protection. If the transaction is outside Section 3, the statutory machinery for delay compensation and refunds is not straightforwardly available to you. You may have contractual remedies, but you are in a much weaker position than a buyer with a registered agreement.

Pricing moves against you. Launch pricing may land higher than indicated, or the specific unit you wanted may not be in the phase you expected.

What this means for you

None of these risks is reduced by paying early. Paying early only increases your exposure to all four of them.

How to Engage Safely

There is a genuinely useful way to engage with a pre-launch project, and it costs nothing.

Register your interest so you are on the notification list. Use the waiting period to do the work: read the promoter’s MahaRERA history on past projects, comparing declared and actual completion dates and reading any complaints. Set your all-in budget including stamp duty, registration, GST and one-time charges. Decide your non-negotiables – minimum carpet area, acceptable floors and orientations, maximum loading – and write them down. Get an in-principle view from a lender on your own eligibility.

Do that and when the price list lands you are not evaluating a project. You already have. You are checking one number against a budget you set calmly, and a shortlist you wrote when nobody was pressing you.

That is the entire advantage of early engagement, and it is available without paying a rupee.

What this means for you

Do the research during the waiting period, not on allocation day. Allocation day is designed to make you flexible about exactly the things you should not be flexible about.

Myths worth clearing up

Myth

A soft booking secures my unit before launch.

Fact

Before registration there is nothing that can lawfully be secured. Whatever the document is called, it does not carry the statutory protection a registered agreement does.

Myth

Pre-launch prices are always a bargain.

Fact

The discount is real but it compensates you for genuine uncertainty about layout, specification, phasing and completion date. Whether it is adequate can only be judged once pricing is published.

Myth

RERA registration means the project is guaranteed.

Fact

It means the project is on the register with sanctioned plans and a committed date, and that there is a forum if things go wrong. It is not a guarantee of delivery, and it is not a substitute for reading the agreement.

The Registration-Day Checklist

When the registration is granted, work through this before committing.

Pull the registration on the authority’s portal and note the number, the promoter, the committed completion date and the phase it covers – a township may be registered as several projects with different numbers and dates, so confirm the one covering your tower. Compare the declared carpet areas against what you were shown. Open the sanctioned plans and check the layout matches the marketing. Read the promoter’s complaint history.

Then have a solicitor read the agreement for sale, specifically the specification schedule, the amenity list, the delay clause and the termination terms. Those four clauses are where your actual protection lives, and they are the ones buyers skip.

Only after all of that does a booking make sense.

What this means for you

Budget for a solicitor to read the agreement. Against the size of the transaction it is a rounding error, and it is the only independent review you will get.

Key takeaways

  • Section 3 prohibits advertising, marketing, booking or selling before registration
  • No more than ten per cent of the cost may be taken before a registered agreement exists
  • Pre-launch pricing is genuinely lower because you are absorbing genuine uncertainty
  • Registering interest costs nothing and carries no commitment – paying money does
  • Verify the registration covering your specific phase, not the one on the banner

Frequently Asked Questions

Is pre-launch booking legal in India?

No, where the project requires registration. Section 3 of the Real Estate (Regulation and Development) Act prohibits a promoter from advertising, marketing, booking, selling or offering for sale any unit before the project is registered with the authority.

What is the ten per cent rule?

A promoter cannot accept more than ten per cent of the cost of the apartment as an advance or application fee without first entering into a registered agreement for sale. If more is being asked before that agreement exists, stop and take advice.

Are pre-launch prices really cheaper?

Launch pricing is commonly set below later phases, because early sales fund construction and build momentum. The discount compensates you for not knowing the final layout, carpet areas, specification or completion date.

What happens if the project is never registered?

Then it cannot lawfully be sold, and money paid in advance sits outside the statutory protections that a registered agreement would give you. You may have contractual remedies, but recovering funds is considerably harder.

Is it worth registering interest before launch?

Yes, provided no money changes hands. It puts you on the notification list and gives you time to research the promoter, set your budget and decide your non-negotiables before allocations open.

How do I check a project’s registration?

Search the project or promoter name on maharera.maharashtra.gov.in. The registration shows sanctioned plans, the committed completion date, the promoter’s other projects and any complaints filed. Confirm the registration covering your specific phase.

How long does a project usually stay in pre-launch?

There is no fixed period. It depends on how quickly the remaining statutory approvals come through and when the promoter chooses to register. Some projects move within months; others sit far longer than anyone intended. That uncertainty is precisely why money should not change hands at this stage – you have no committed completion date to hold anyone to, and no registration number to check anything against.
